Abstract From the lesson that Qin Dynasty perished for lts severe laws and for the necessity that people needed a rest after yearlong battles, thc peaceful and toIerant approach of Huang-Lao’s ruIing means became the most proper guideline for Western Han Dynasty. However, since the Innate factor of folIowlng Qin’s institutions as weIl as the postnaturaI request of centraIizing the authonty, Western Han Dynasty couIdn’t totally dispose the old names of thc penal codes and the systems of jurisdiction which were designed by Oin In Dynasty, For this reason, the ruIing means of Western Han Dynasty reveaied an incIuslve characteristic Which incIuded tenderness and strictness, punishment and exoneration, Its approach was representing Tao with Fa inside, settlng forth Tao with Fa behind. This approach fits the records on silk letters of Huanug-Lao quite well. Moreovcr, we can prove this by three aspects: One is the political measures on soclety, economics, livelihood, and laws which were adopted by Fmperors Gao, Hui, Queen Gao, Emperors Wen as well as Jing ln Western Han Dynasty; one is the behavior and conduct of the contemporary emperors or briIIiantt officiaIs; the other one is the ideoIogicaI incIination of scholars of that time.
